Lawyer: I Offer Legal Revenge Advice
Chapter 92 - 74: The Legal Battle Turns Magical
"Presiding Judge, the prosecution’s agent has broken the law! The defense requests he be removed from the court!"
"Furthermore, according to Article 68 of the High Court’s Rules on Evidence, the agent has clearly infringed upon the legal rights and interests of others and violated prohibitive provisions of the law!"
"This is a serious violation of public order and good morals! Any item he has obtained cannot be used as a basis for a verdict!"
At the defendant’s table.
Zhang Wei’s mind was racing, adrenaline coursing through his veins. He shouted in agitation, like someone had stomped on his foot.
He had become a Gold Medal Lawyer five years ago after a major victory in a criminal case.
During that case, he had pushed his abilities to their absolute limit. He felt his mind become brilliantly clear, countless lines of thought flooding his brain for him to choose from.
Zhang Wei had thought that would be the peak state of his entire life.
But compared to now... it was nothing!
At this moment, it was as if his brain had been lubricated. Adrenaline surged through him, pushing his body to its absolute peak, and a sense of urgency spurred him on from within.
Zhang Wei roared:
"The agent has violated the witness’s right to privacy! This has already reached the standard for filing a case. The defense requests his recusal!"
"Furthermore, the opposing counsel’s words clearly contain multiple leading statements. The subsequent testimony from the witness, Lv Guangjun, was obviously influenced by him. The entire video is false evidence!"
"The defense reserves the right to pursue criminal charges against him!"
He was getting desperate.
He had no choice. If he didn’t act now, things would get truly serious.
The things Lv Guangjun said... could very well bring this entire criminal case to a close!
On the judge’s bench.
’An evidentiary ambush... cross-examination in court...’
The three judges’ expressions turned grim.
For this kind of evidence to be brought out now... and yet, they couldn’t afford to dismiss it. They had to treat it with caution!
After a long moment, Presiding Judge Zhang Bingxin finally took a deep breath, turned his head, and looked at Xu De with a dark expression.
"Agent, do you have any objections or responses to the opposing party’s accusations!?"
As soon as the words fell, it was a clear signal for both sides to begin the cross-examination phase.
If the evidence was deemed valid... the defendant could forget about a reduced sentence. They might as well just pack up and leave.
Normally, this would be followed by a fierce debate, but instead...
At the agent’s table.
Xu De remained silent, as if his ears were plugged and he hadn’t heard a single word.
At the prosecutor’s table.
Huang Shi’s face was flushed red. His gaze darted between the judges and the defendant, his fists clenched tightly.
Presiding Judge Zhang Bingxin spoke again.
"Agent, does your side wish to proceed with cross-examination?"
Xu De still didn’t speak.
Lin Yue and Wang Chao also looked like they had nothing to say. The scene... was somewhat similar to losing a cross-examination and being rendered speechless.
Huang Shi grew increasingly anxious, wanting to speak several times but holding himself back.
On the judge’s bench.
The three judges all frowned. Finally, Judge Lu Guowei said sternly:
"Agent!"
"Your submission of this evidence constitutes an ambush on the court. If you do not speak now..."
"The court will not accept this video recording!"
Not accepted...
As his words fell, Xu De still said nothing. He remained utterly silent, offering no explanation whatsoever for the source of the evidence.
Seeing this, although Zhang Wei didn’t know what he was up to, he couldn’t help but say anxiously:
"Presiding Judge, the evidence submitted by the opposing counsel is a severe invasion of the witness Lv Guangjun’s private space!"
"The agent has clearly committed the ’crime of illegal use of listening devices’ under Article 284 of the Criminal Law!"
"He has also violated Article 42, Section 6 of the Public Security Administration Punishments Law. His actions constitute peeping, covertly filming, eavesdropping, and disseminating the private information of others!"
"Furthermore, he concealed a hidden device for secret recording, exceeded the scope of conversational consent, and violated Lv Guangjun’s expectation of privacy during a private, solitary phone call!"
At this moment, Zhang Wei felt as if legal precedents that had once been obscure and difficult to understand were now appearing in his mind with the clarity of an epiphany.
He didn’t even have to think. The moment he opened his mouth, countless relevant statutes and precedents came pouring out.
On the judge’s bench, the three judges hadn’t even had a chance to state their position.
The next second...
Before the agent’s table could say anything, an angry shout suddenly erupted from the prosecutor’s table.
"Objection! OBJECTION!"
"Presiding Judge, the evidence submitted by the agent is completely legal and compliant! There is no suspicion of any violation of laws or regulations. The defense’s claims are pure slander! The prosecution requests that this video be admitted as definitive evidence!"
At the prosecutor’s table.
Huang Shi simply couldn’t hold back any longer. He loudly protested to the judge, his voice filled with anger.
In the past, he never believed that evidence from an evidentiary ambush could be legitimate. He would sometimes even refute an agent’s evidence and express disdain for it.
But now, on December 17th, at two-thirty in the afternoon...
When Huang Shi saw that half-hour-long video, he knew that this piece of evidence...
was absolutely legal and compliant!
And he’d fight anyone who said otherwise!
"Presiding Judge!"
Huang Shi slammed his hand on the table, his tone filled with urgency.
"The content of this recording is objective and true, it has not been altered or edited! Its authenticity is confirmed and requires no further cross-examination!"
At the defendant’s table.
Almost at the exact moment the prosecutor’s voice fell.
"Presiding Judge!"
"According to Articles 130 and 131 of the Civil Code, when a civil subject exercises rights and performs obligations, they must follow the principles of volition, fairness, equality, and good faith!"
Zhang Wei and Sun Bing immediately spoke up, their angry rebuke a direct rebuttal.
"This video was covertly recorded, and the method of evidence collection was not truthfully disclosed! This is a clear violation of the fundamental principle of ’good faith’!"
"Furthermore, according to the ’Defense on the Continuity of Recording,’ the agent had already left the recording location during the filming. At that point, this recording was, in legal theory, terminated!"
"Everything recorded after that point constitutes illegal covert recording!"
It all came pouring out.
